Science has been taken in progress especially the science of medicine and surgery. It has come a long way to enable transplantation of organs from the neighborhood to the neighborhood and from the dead to the living. There is no doubt that this scientific progress is the greatest blessings of God on the human and therefore God forbid despair, he said: Do not despair of the spirit of God that he does not despair of the spirit of God, but the disbelievers, as the Almighty God forbid the killing of the soul and assault it Almighty: Do not receive your hands to destruction. He said: “Allaah has bestowed charity on everything.” It is a charity to revive the soul until God says in His Noble Book: Whoever kills a soul without a soul or corruption in the earth, it is as if he killed all the people and whoever revived it, as if he had revived all the people.
It is recommended to some parts of his body to some of his brothers of humanity who lack him. It was a mercy. The Messenger of Allah Muhammad (peace and blessings of Allaah be upon him) said: “Have mercy on those in the earth who will have mercy on you from the sky.” Yes, the condition is to be from the people of the donation, that is to be aware of a wise adult. And the community must carry out his will and make his body under his recovery so that the members of his body remain valid and can be used to those who need it and this permission to use the parts of his body of his generosity and perfection of humanity. And perhaps the course of ongoing charity. How not to have this reformed souls.
Here we wish to reconcile some of the provisions of the transfer of organs:
The meaning of the benefit that is the subject of research is the benefit of the need or need of the beneficiary to retain the origin of life or to maintain the function of the body, Basic of the functions of the body, such as sight and so on that the beneficiary enjoys a life of respectable law. These user images are divided into three sections:
First: Transfer the member from the neighborhood.
Second: Transfer from the dead.
Third: Transplantation of the genitals.
Transfer member from neighborhood:
The first image transfers the member from the same person to another place of his body such as the transfer of skin, cartilage, bones, veins and the like. This transfer was governed by an agreement, ensuring that the expected benefit of this process was more likely than the damage caused.
The second image transfers a member from one human body to another. And here is the view of this member is it depends on which life depends on it first. Then, if life depends on it, it may be individually, not as multifaceted as the liver and the heart. It may be mild as kidneys and lungs. Then the life of the deceased is renewed, if part of it is removed and from it it is not renewed if it is eradicated.
If the tissue is automatically renewed as the bone marrow, it is permissible, taking into consideration that it is going on
• Achieves the legitimate interest considered.
• An organ or tissue removed from the body may be transferred to another person’s illness, such as taking a spongy bone to a person when the bone is removed for a disease.
• If the organ that has been removed is part of it, it is automatically renewed as the liver if it is permissible if the excision of the part of the liver does not affect the donor’s health.
• If the member is married as a kidney. May be donated under the condition of verification that this donation does not affect the health and psychological state of the donor.
It is haraam to transfer a member on whom life depends like the heart from one living person to another.
In all five cases, the donor must be fully qualified. The donation can not be made for any price by selling to that member or fabric. This is because man does not have himself, but he is the king of God. It is not permissible to subject anyone to sale in any way.
Transfer a member of the dead:
A member may be transferred from a dead person to a neighborhood where his life depends on that member or the safety of a basic function ceases, provided that the deceased is authorized before his death or his heirs after his death or on the condition of the consent of the guardian if the deceased is anonymous or has no heirs.
Transplantation and implantation of the gonadal gland Because the ovaries and ovaries continue to carry and produce the genetic traits (genetic code) of the transferee with the intention of planting them in a new recipient, its implantation is prohibited by law. As for those who do not transfer genetic traits, it is permissible to resort to legitimate requirements according to Islamic laws and regulations.
Finally, we note that if a person writes a document for the donation of a member after his death, the provisions of the will apply, and the heirs or others may not change the will.
As we explained, we urge people to donate organs, especially after death. And that it is the greatest proximity to God. It is a mercy for humanity. And from the womb of people, God’s mercy.
